Rape is a criminal act defined as the non-consensual penetration of another person with a sexual organ or object. This penetration could involve the mouth, vagina or anus.

In 2012, 5,524 cases of forcible rape were reported in the state of Florida. According to a national survey administered in 2010, 17 percent of all females in Florida claimed to have been raped at some point in their lives, with more than 40 percent of them under the age of 18 when they claim their first rape occurred.

Penalties for rape vary widely and depend upon the ages of the parties involved and the circumstances surrounding the crime:

  • If the accused is 18 or older and the victim is under 12, the crime is a capital felony, punishable by death.
  • If a person under the age of 18 (a minor) is convicted of raping a child under 12, it is a life felony, carrying a sentence of life imprisonment.
  • If the victim is 12 or older, the crime is a second-degree felony, which holds a penalty of up to 15 years in prison and possibly a fine of up to $10,000. If physical force or a deadly weapon is used, the penalty could be increased to a life felony.
  • Under certain circumstances, a rape conviction can be a first-degree felony, which carries a sentence of up to 30 years in prison. Such circumstances could include drugging the victim, threatening violence, threatening retaliation or raping someone who is physically unable to resist.
  • Anyone convicted of a felony rape charge must register as a sex offender or sexual predator with the State.
